- General
1.1 These general terms and conditions (the "Terms") apply when you as a consumer (the "Customer") place an order via Tasty America and related pages, (the "Website"). Agreement is entered into between you and Tasty America AB, organization no. SE559072766401 ("Tasty America"). Detailed contact information and other information about Tasty America can be found on the Website. The terms are only applicable to the Customer who is a consumer and who makes orders via the Website.
1.2 To be able to order on the Website, the Customer must be 18 years of age or older. According to the law, Tasty America AB does not accept credit purchases (credit cards, invoices, installments) to persons under 18 years of age. Tasty America reserves the right in individual cases to refuse or change a Customer's order (for example, if the Customer has provided incorrect personal information and / or has payment remarks).
1.3 Tasty America reserves the right to final sale and any image and writing errors on the Website, such as errors in product description or technical specification, incorrect prices and price adjustments (such as changes in prices from suppliers, currency changes) or incorrect information regarding whether an item is in stock. Tasty America reserves the right to correct any such errors and to change or update the information at any time. If an incorrect price has been stated for an item that the Customer has ordered, Tasty America reserves the right to remove the product from the Customer's order. All image information on the Website is to be considered as illustrations only. Such illustrations cannot be guaranteed to reflect the number of items the Customer receives or the exact appearance, features or origin of the item. Tasty America is not responsible for information on the Website coming from a third party.
1.4 The Website, and all content on it, is owned by Tasty America or its licensors. The information is protected by, among other things, intellectual property law and market law. This means that trademarks, company names, product names, images and graphics, design, layout and information about goods, services and other content may not be copied or used without the written permission of Tasty America.
- Agreement and Order
2.1 In order to make a purchase via the Website, the Customer must accept the Terms. By accepting the Terms, the Customer undertakes to comply with the Terms in full, and agrees that they have read the information about personal data and consented to the use of personal data and cookies in accordance with Tasty America's Privacy Policy, see Privacy Policy.
2.2 A purchase agreement is entered into only when Tasty America has confirmed the Customer's order and the Customer has received an order confirmation from Tasty America by e-mail. Tasty America urges Customer to save this order confirmation for any contact with Tasty America Customer Service (Contact us). The customer can withdraw their order until it has started to be picked by Tasty America. If the order is revoked, Tasty America will refund any payments made by the Customer or its debit or credit card Company regarding the order.
- Customer information etc.
3.1 Tasty America recommends that the Customer create a user account before the Customer purchases on the Website. When the Customer registers his user account and/or has to complete an order, the Customer will be asked to provide certain personal information. The Customer confirms that the information that the Customer fills in is correct and complete and is responsible for incorrectly filled in information. Information about Tasty America's processing of personal data can be found in Tasty America's Privacy Policy, which is part of these Terms.
3.2 The Customer undertakes to ensure that no one other than the Customer can use the Customer's login information. The customer must not reveal the username and password of any unauthorized person and must ensure that the document with information about the username and password is stored in such a way that the unauthorized person cannot gain access to the information. The Customer must immediately notify Tasty America if it can be suspected that an unauthorized person has gained access to the Customer's password. The customer is responsible for all purchases made with his login details if such notification has not been made.
3.3 If Tasty America suspects that the Customer is abusing their user account or login information or otherwise violates the Terms, Tasty America has the right to suspend the Customer’s account.
- Prices, fees and payment
4.1 When ordering via the Website, the prices stated on the Website apply. Prices are stated in various currencies by region and include VAT. Prices do not include payment and shipping fees, which are stated separately.
4.2 The customer can pay in the manner specified on the Website. Read more about our payment methods and discounts on the Website's Payment Terms. Tasty America has the right to charge the Customer already in connection with the order, unless invoice payment or other similar payment method is chosen by the Customer (where applicable) and approved by Tasty America. In the event of invoice payment or partial payment, Tasty America or its partners may make a credit report. In such a case, you will be informed of this. Tasty America reserves the right not to always offer all payment methods, or to change payment methods if what the Customer has chosen for any reason does not work at the time of purchase. Please note that any restrictions on payment options are set out on the Website.
- Promotions and offers
Tasty America may from time to time offer promotions on the Website which may have more favorable terms than those set out in these Terms, e.g. concerning payment or extended right of withdrawal. These more favorable terms apply as long as the promotion is active and for the specific items specified by Tasty America in connection with the promotion. Tasty America reserves the right to revoke such promotions at any time. Upon termination or revocation of a promotion, these Terms apply without modification. Offers on specific items on the Website are valid as long as stock lasts.
- Delivery and transport
6.1 Goods that are in stock are normally delivered within the number of working days specified on the Website for your specific delivery destination. Unless otherwise specifically agreed (e.g. in connection with the booking of goods that are not in stock), delivery typically takes place in approximately 1-4 working days from the time Tasty America confirmed the order in writing through the order confirmation. More information about Tasty America's delivery of goods and terms of delivery can be found under Delivery Terms.
6.2 If packages are to be redeemed, the Customer must do so within the time specified in the notification. Packages must normally be picked up in person with valid identification and order number. The customer always receives a notification that shows where and when packages are to be picked up. Notification can be made via e-mail, regular mail and if the Customer has provided a mobile number, also via telephone call or SMS. If the Customer does not pick up the package, Tasty America has the right to charge the Customer a fee of ~20 EUR plus shipping costs, the fee is for work completed, restocking and administration fees. Please note that unredeemed packages do not fall within the scope of the right of withdrawal or free returns.
- Right of withdrawal
7.1 When purchasing goods on the Website, a 14-day right of withdrawal always applies in accordance with current consumer protection legislation (NOTE: not applicable for food items). This means that the Customer has the right to cancel his purchase by notifying Tasty America within 14 days of the Customer or the Customer's representative receiving the ordered item (NOTE: not applicable for food items). Also, if the quality of the product has been affected as a result of you as a customer having handled it more than is necessary to investigate its properties or functions, a deduction on the refund corresponding to the depreciation of the product will be made, e.g. faulty or broken carton, broken packaging. An administration fee will also be applicable for returned shipments to cover shipping and administration costs.
7.2 The right of withdrawal does not apply to goods with a broken seal
7.3 Right of withdrawal of food. When ordering food, no right of withdrawal applies.
7.4 By the Customer accepting the Terms, the Customer agrees to the right of withdrawal.
7.5 If the Customer wishes to cancel the purchase, the Customer must, before the withdrawal period has expired, send a clear and unambiguous message to tasty America in the manner specified under Right of withdrawal, Return & Exchange. The customer must enter his name, address and other relevant information, e.g. order number, invoice number and name of the item in the message. Returned packages not fall within the scope of the right of withdrawal and Tasty America reserves the right to charge the customer ~20 EUR plus shipping cost to cover Administration and restocking costs.
7.7 Tasty America will repay the amount as soon as possible through the payment processing service used to facilitate the transaction. However, Tasty America will have to wait to issue the refund until Tasty America receives the returned item. The refund will be made to the Customer via the payment alternative (where applicable) chosen by the Customer, provided that nothing else has been agreed or that there are obstacles to such a refund. Tasty America takes no responsibility for clear repayment times and handling.
7.8 All return shipping is paid by the customer.
- Warranty and Complaint
8.1 In the event that goods are missing, damaged or otherwise deviate from the "standard condition" regarding the content, Tasty America must be contacted within one week (7 days) of receipt. If an item is missing or damaged, the incorrect item will be credited.
8.2 Some of Tasty America's products may be covered by warranty. Information about any warranty period and special warranty terms for each item can be found on the product page. Warranty for goods only covers original manufacturing defects, this does not apply to food.
8.3 The right of complaint covers goods that are defective in accordance with current consumer protection legislation. A customer who wishes to make a valid error in the ordered product must contact Tasty America as soon as possible after the error has been discovered via the contact information stated on the Website. In the case of a complaint or warranty case, Tasty America reserves the right to take some time as the supplier of the product is the one who decides on the approval of the case.
8.4 Tasty America, however, reserves the right to damage caused by external factors during delivery such as temperature, shaking and shock. To clarify, it is the contents of the product that are sold, so even if there is some damage to the packaging that can easily occur during transport, it does not give the right to a complaint. Of course, we do our utmost to pack and package your order in such a way that damage will not occur during transport, but it is not possible to 100% ensure that the packaging is not slightly damaged. For example, there may be dents on chip tubes, soda cans, tinned products and flakes, but this without damaging the contents. Applicable to chips, they are often shaken in transport and cannot be protected, so you can expect that a certain proportion will be damaged in transport.
8.5 Cans for Collectors, We can unfortunately not guarantee that cans containing beverages will arrive in perfect condition, but they may have some beauty defects. We do our utmost to ensure that they are packed so well that this does not occur, however, we get cans from our suppliers who already have a defect.
8.6 Tasty America is responsible for return shipping for approved complaints.
8.7 When the complained product is returned and the complaint is approved, Tasty America will compensate the Customer in accordance with applicable consumer protection legislation. Tasty America strives for this to happen within 30 days of Tasty America receiving the complaint, but it may take longer depending on the nature of the product. Tasty America reserves the right to refuse a complaint if it turns out that the product is not defective in accordance with current consumer protection legislation. In the event of complaints, Tasty America follows guidelines from the General Complaints Board or equivalent boards in other European countries.
- Force Majeure
9.1 In the event of circumstances beyond Tasty America's reasonable control, such as in the event of a change in legislation, government action, strike, blockade, sabotage, war, terrorism, fire, flood, natural disaster or similar events, Tasty America's obligation to fulfill the purchase agreement shall be suspended as long as the circumstance prevails. If such delay exceeds 2 months, both you and Tasty America have the right to terminate the agreement with immediate effect without any obligation to pay damages.
- Changes to the Terms
10.1 Tasty America reserves the right to make changes to these Terms at any time. All changes to these Terms will be posted on the Website. Changes apply from the Customer's acceptance of the Terms (in connection with a new purchase or when visiting the Website), or 30 days after Tasty America has notified the Customer of the changes. However, Tasty America recommends that the Customer stay updated on the Website regularly to be notified of any changes to the Terms.
- Applicable law and dispute
11.1 Disputes shall primarily be resolved by agreement after discussion with Tasty America's customer service.
11.2 If a dispute cannot be resolved in agreement with Tasty America's customer service, you as a customer can turn to the General Complaints Board for your country. You can also file complaints directly online via the European Commission's Dispute Resolution Platform, which can be found at the following link http://ec.europa.eu/consumers/odr. If you submit a complaint via this platform, your case will be automatically forwarded to the appropriate nationally responsible dispute resolution body. This dispute resolution body then contacts us and tries to resolve the dispute without interfering with the court.
In the event of a dispute, Tasty America follows a decision from the General Complaints Board or an equivalent dispute resolution body.
11.3 Disputes concerning the interpretation or application of these Terms shall be interpreted in accordance with Swedish law and settled in accordance with clause 11.2 above or ultimately by a general court.
